BuildingBands.com Artist Agreement

This Artist Agreement is a binding legal agreement between the artist (or authorized representative of the artist) and BuildingBands.com regarding the use and distribution of the artists materials through the website BuildingBands.com.  The artists retain all rights to the materials provided by the artists including copyrights.

Artists grant BuildingBands.com non-exclusive rights to all uploaded materials throughout the entire website (BuildingBands.com) free from all fees and royalties.  This includes but is not limited to sound recordings, audiovisual works of the artists vocal or musical performances, biographical information, likeness, trademarks, trade names, and any other text or material provided by the artist to BuildingBands.com. At any time the artist or representative of the artist may cease to grant BuildingBands.com rights to any of the uploaded material with a 60 day written email to the address located on the Contact portion of the website.

Artist profiles are for Artists Only. Profiles may not be set up for any other type of organization.  These organizations include but are not limited to Record Labels, Recording Studios, Production Companies, Tours, Compilations etc. These profiles will be deleted immediately. Ownership Rights: The artist affirms that all materials uploaded to the website (BuildingBands.com) are the artists own personal property.  If a representative of the artist is posting materials that are not his/her property, the representative must have expressed written permission by the owner of the copyrights and materials.  Any material uploaded to the website (BuildingBands.com) by someone other than the artist without expressed written permission will be deleted.

Termination of Services: You may terminate your BuildingBands.com account, thus revoking all rights granted to BuildingBands.com at any time with a prior 90 day written email (to the address located on the Contact portion of the website) or by using the tools provided in the Artists Area.

Copyright/Ownership Disputes: In the case of copyright or ownership disputes, BuildingBands.com recommends that disputing parties attempt to resolve issues between themselves.  If this cannot be done the parties agree to refer such issues to mediation with an agreed upon impartial third party.  Upon discovery of infringement of copyright violations, BuildingBands.com will remove all materials in violation and reserves the right to terminate the user's account.

BuildingBands.com Review and Right to Remove: BuildingBands.com reserves the right to remove or reject any and all materials the artist or representative of the artist provide.  Buildingbands.com reserves the right to terminate the artists account at any time.
General: BuildingBands.com approves accounts electronically, among other methods.  It is inconceivable that all errors or inappropriate material will be reviewed by BuildingBands.com.  It is the artist and representatives of the artist's responsibility to adhere to all copyright laws as well as checking the artist's materials for errors, violations and unlawful obscenity.  BuildingBands.com is for the personal use of members and promotion of artist members only.  Organizations, companies, and/or businesses may not become Members and should not use the website (BuildingBands.com) for any purpose without the express consent from BuildingBands.com.  Illegal and/or unauthorized uses of the website (BuildingBands.com), including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the website (BuildingBands.com) will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.  BuildingBands.com reserves the right to make changes to this Agreement at any time without prior notice or warning.

BuildingBands.com does not warrant that the service will be uninterrupted or error-free. In addition, BuildingBands.com does not make any warranty as to the results to be obtained from use of the service or the content. The service and the content are distributed on an "as is, as available" basis. Any material downloaded or otherwise obtained through the service is done at your own discretion and risk, and you will be solely responsible for any potential damages to your computer system or loss of data that results from the download of any such material. BuildingBands.com does not make any warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose, with respect to the service, any content or any products or services sold through the service.  You expressly agree that you will assume the entire risk as to the quality and performance of the service and the accuracy or completeness of its content. BuildingBands.com shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the service, even if BuildingBands.com has been advised of the possibility of such damages.
